TERMS AND CONDITIONS
1. Website Usage Agreement. You agree to be bound by and comply with the Terms and Conditions outlined at this website. You also agree to comply with any rules or guidelines regarding any Product or Service, including your DermaRadiant Perpetual Youth Program Membership. You shall always act in accordance with the law and in good faith. You may not make any changes to the site or any content or services that may appear on this website. You shall be liable for all losses and damages that this violation may cause DermaRadiant, our affiliates, partners or licensors. DermaRadiant reserves the right to change, modify or otherwise alter these Terms and Conditions at any time.
2. Privacy. Please review our Privacy Policy, which also governs your visit to the Site.
3. Children's Privacy. The Site does not direct its activities at children under the age of 13. If future site activity is directed at children 12 or under, it is the company's policy to include parental notice and/or consent features consistent with the Children's Online Privacy Protection Act.
4. Protection of Information. DermaRadiant uses appropriate industry standard procedures to safeguard the confidentiality of personal information including the use of firewall, encryption, token authentication, application proxies, monitoring technology and adaptive analysis of network traffic to track abuse of our network and its data. DermaRadiant does not sell or rent personal data provided to us by our customers to any 3rd parties for the purpose of marketing, all your data is safe with us.
5. Site Usage Guidelines. By entering any information on the site, you represent that you are at least 18 years of age; you have provided only true, current, accurate and complete information; and you will maintain and promptly update the information that you provide to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your account and refuse any and all current and future use of the site.
6. Purchase Policies. The products and services available on the Site, and any samples thereof we provide to you, are for personal use only. You may not sell or resell any of the products or services, or samples thereof; you purchase or otherwise receive from us. We reserve the right, with or without notice, to cancel or reduce any order, DermaRadiant Perpetual Youth Membership, or future orders from persons whose actions may result in violation of our Terms and Conditions. We also reserve the right to reject any order you place with us, and/or to limit quantities on any order, without giving any reason. If we reject your order, we will attempt to contact you by email to notify you of such rejection and you will never be charged for any order not processed or shipped.
7. DermaRadiant Perpetual Youth Program By joining the Perpetual Youth Program you agree, accept and understand the following Membership rules.
(a). You are over the age of 18 and can form a legally binding contract under applicable law.
(b). You have provided and will continue to provide only true, accurate, current and complete information about Yourself when filling out the DermaRadiant Perpetual Youth Program purchase agreement.
(c). You will receive the DermaRadiant 2-Step Miracle each month unless modified via email orders@dermaradiant.com and you will receive an email confirmation of any change being preformed - if you do not receive an email confirmation within 2 business days please call us at 1-561-922-5963 to confirm any modifications to your account. Although we make every effort to ensure email delivery unfortunately emails may be blocked by an ISP or SPAM software. DermaRadiant will charge your credit card on file each month for the 2-Step Miracle unless shipping cycles have been modified as outlined above or cancelled.
(d). Perpetual Youth Membership shipping cycles are set to a default of 30 days, to modify this cycle or cancel future orders simply email orders@dermaradiant.com. if using email a confirmation email back from us will confirm that your account has been modified to your specifications - if you do not receive an email back from us within 2 business days please contact us via phone to confirm as your email may have been lost during transmission. It is your responsibility to confirm that your email has been delivered and that your account has been modified correctly.
(e). All Memberships shall renew at each 30-day period subsequent to shipment of the first full-sized product selected and agreed to by the client. The maximum term of this agreement is 56 months. Unless and until this agreement is modified or cancelled in accordance with the terms outlined by your DermaRadiant Perpetual Youth Program, customer hereby authorizes DermaRadiant to charge customer's credit card to pay for the ongoing cost of Membership and all agreed to purchases of products in the Membership Agreement.
(f). Membership can be modified or cancelled at any time by contacting customer service at orders@dermaradiant.com or by calling 1-866-439-6953. Members may modify their shipping cycles to 45 days, 60 days or 90 days plus they may add or remove products at anytime. Modified Memberships shall be binding and supersede the original Membership in our DermaRadiant Perpetual Youth Program at the point of sale.
(g). Cancellations are not retroactive. If a member cancels after their Renewal or Shipment Date, the Member will not be entitled to a refund for the Membership Fee for that month. Cancellations do not become effective until the Member's next product shipment.
(h). DermaRadiant may modify, suspend or discontinue the Membership Rules for the DermaRadiant Perpetual Youth Program without prior notice.
You agree that your placement of any order and/or membership in our DermaRadiant Perpetual Youth Program is sufficient to satisfy the Statute of Frauds. All Rules and Regulations of every transaction shall be governed by the State of Florida. Terms of payment are within our sole discretion, and unless otherwise agreed in writing, payment must be received by DermaRadiant prior to our acceptance of an order or acceptance into our DermaRadiant Perpetual Youth Program. Orders are not binding until the order and/or DermaRadiant Perpetual Youth Program Membership is accepted by DermaRadiant. DermaRadiant conditions its acceptance of your order or your DermaRadiant Perpetual Youth Program Membership on your agreement to these Terms and Conditions.
8. DermaRadiant Perpetual Youth Cancellation Policy
All transactions will be governed by the Rules and Regulations of the state of Florida. DermaRadiant is so confident in our products efficacy that we believe all of our valued clients will be satisfied with their purchase. DermaRadiant is a superior product that yields phenomenal results.
Those clients who participate in our DermaRadiant Perpetual Youth Program can cancel their membership anytime 24 business hours prior to shipment by contacting customer service at orders@dermaradiant.com or by calling toll free 1-866-439-6953. Cancellation of your DermaRadiant Perpetual Youth Program assures the client that they will not be charged and shipped any subsequent product offerings set forth in the DermaRadiant Perpetual Youth Program at the point of sale. Modifications made to the terms of the DermaRadiant Perpetual Youth Program after the point of sale can be made by contacting customer service at orders@dermaradiant.com or by calling toll free 1-866-439-6953. These modifications will be binding until client cancels their DermaRadiant Perpetual Youth Program. Cancellations are not retroactive.
If you cancel your DermaRadiant Perpetual Youth Program 24 hours prior to shipment and recive email confirmation from us and a charge is still made to your card, you will be eligible for a full refund. Please email customer service at orders@dermaradiant.com or call toll free 1-866-439-6953 if you should incur a charge after cancellation of your DermaRadiant Perpetual Youth Program.
If your shipment should be lost, stolen or damaged during shipment, please contact orders@dermaradiant.com or 1-866-439-6953 and DermaRadiant will ship to you a full replacement at no additional charge.

9. DermaRadiant Returns/Refund Policy DermaRadiant is a superior product that will yield phenomenal results for those that utilize our 2-Step Program over the recommended time period of 56-90 days. DermaRadiant has combined the ultimate active ingredients available and relies on clinical trials conducted with volunteer subjects to back up our claims. We provide a product that is unrivaled in reducing fine lines and deep wrinkles, puffiness and dark circles under the eyes, and unattractive crows feet-creating a more radiant looking you.
If for any reason you are not satisfied with your 30-day supply of product/products from the DermaRadiant Perpetual Youth Program, you may return the white DermaRadiant box with the unused products for a full refund (less shipping and handling). Your return must be received at the address provided below within 30 days of initial purchase (or ship date of the DermaRadiant Perpetual Youth Program's 30-day supply). Returns must meet the following conditions:
- All merchandise must have the name/order number/email address of the buyer as recorded by www.dermaradiant.com at the time of enrollment and MUST include a RAN (return authorization number). This allows us to associate the return/refund action to the appropriate member.
- Please do not mark "Return to Sender" and refuse delivery. This may result in a refund that cannot be applied to the proper member - contact customer service to obtain an RAN prior to return or credit will not be issued. Please work with us to provide the best possible service to ensure complete customer satisfaction.

10. Shipping. Please understand that product availability may be limited. DermaRadiant standard delivery time is 5 to 7 business days, although we cannot guarantee delivery within this time frame. DermaRadiant shall not be liable for any loss, damage or expense related to any delay in shipment or delivery.
11. Modification/Cancellation Notice. We may modify, suspend or discontinue any product, service, promotion or advertisement without prior notice at any time. Prices and availability of the products or services listed on this site are subject to change without notice. In the event that a DermaRadiant product or service is listed at an incorrect price due to typographical error or error in pricing on our part, DermaRadiant shall have the right to refuse or cancel any orders placed for product or service listed at the incorrect price.
12. Members Area Guidelines. You may choose to register at our site or you may be given an account upon completion of purchase. If you do, you will have an email address/username and password for your account. You are responsible for maintaining the confidentiality of your account, username and password. You agree to accept responsibility for all activities that occur under your account, username and/or password. DermaRadiant reserves the right to refuse service or terminate accounts without prior notice if you violate these Members Area Guidelines or if DermaRadiant decides in its discretion that it is in our best interests to do so.
13. Account Termination. If you wish to cancel a username or password, or if you become aware of any loss, theft or unauthorized use of a username or password, you must notify us immediately. We reserve the right to delete or change any username or password at any time and for any reason. We may suspend or terminate your account or your use of this site at any time or for any reason. You are personally liable for any orders that you place or charges that you incur prior to termination.
14. Submissions. Any idea or other information you provide us via email/mail or other form of communication will be treated as non-proprietary and non-confidential (collectively, 'Submissions'). You hereby grant us a nonexclusive, royalty-free, perpetual, transferrable irrevocable right to use, reproduce, adapt, modify, sell, publish, assign, translate, distribute and display any Submission in any form, media, technology or other medium whether now known or hereafter developed. You also acknowledge that your submission or any concepts or ideas contained therein may be used for any purpose including, without limitation, developing, manufacturing, marketing or distributing products or services by DermaRadiant.
15. FDA Disclaimer. The information on this site has been included in good faith for informational and promotional purposes only. It should not be relied upon as medical advice and no representation or warranty is given as to its accuracy or completeness. DermaRadiant products contained in this site have not been approved by the FDA or any other regulatory body for treatment of any disorder. The information on this site is not intended to diagnose, prevent, treat or cure any disease.
16. Communications. When you communicate electronically with DermaRadiant or when DermaRadiant responds electronically, you hereby agree that all notices, agreements, disclosures and other communications sent to or from DermaRadiant and user satisfy any legal requirement that such communications be in writing.
DermaRadiant may also elect to electronically monitor areas of the site and may disclose any records, content or electronic communication of any kind to satisfy any law, regulation or government request. Such disclosure may be necessary or appropriate to operate the site or to protect our rights or property or the rights of users, licensors, sponsors, providers or merchants.
17. Warranties; Representations; Limitation of Liability. We make no warranties or representations of any kind whatsoever, expressly implied, in connection with these Terms and Conditions or the site, including but not limited to warranties of merchantability, non-infringement of fitness for a particular purpose, except to the extent such warranties and representations are not legally excludable.
18. Intellectual Property. All content available on the site and the compilation thereof is the property of DermaRadiant. The trademarks, service marks, and logos displayed on the Site are the registered and unregistered marks of DermaRadiant, our affiliates, partners or licensors, in the other countries on in the United States, and are protected by United States and international trademark laws. Neither the content or trademarks nor any portion of the site may be reproduced, used duplicated, copied, modified, accessed, sold, resold or otherwise exploited, in whole or in part, for any purpose without our prior written consent.
To the fullest extent permitted by law, we will not be liable for any special, indirect, consequential or incidental damages of any kind (including lost profits) related to the site regardless of the form of action whether in contract, tort or otherwise, even if we have been advised of the possibility of such damages.
You agree that, to the fullest extent permitted by applicable law, we will not be responsible or liable (whether in contract, tort or otherwise), under any circumstances, for any (a) interruption of business; (b) data non-delivery, mis-delivery, corruption, destruction or other modification; (c) access delays or access interruptions to the site; (d) loss or damages of any sort incurred as a result of dealings with or the presence of off-website links on the site; (f) any inaccuracies or omissions in content or; (e) computer viruses, system failures or malfunctions which may occur in connection with your use of the site, including during hyperlink to or from third party websites; (g) events beyond our reasonable control.
19. Indemnification. You agree to indemnify, defend and hold us harmless for any loss, costs, or damages including reasonable attorney's fees, resulting from any third party claim, demand or action resulting from your use of the site. You also agree to indemnify us for any loss, costs or damages, including reasonable attorney's fees, resulting from your use of software robots, crawlers, spiders or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on DermaRadiant infrastructure.
